- ★ ☆ ☆ ☆ ☆ By John Challenger29/06/2017You should have received the recorded delivery letter I posted first class yesterday advising you that I was rejecting your kitchen because you were in breach of contract. At first, your stance was "bring it back yourself but you will pay a 20% handling fee". I was legally advised that you were in breach of contract and to send you a recorded delivery letter via Royal Mail and request a refund in full. I decided not to seek damages as a result of your actions. At first, your stance was "bring it back yourself but you will pay a 20% handling fee". I was legally advised that you were in breach of contract and to send you a recorded delivery letter via Royal Mail and request a refund in full. You then did a uturn and told me that you would take the kitchen back. You confirmed that in a Facebook post that I have a screen print of. I decided not to seek damages as a result of your action. You said you would make enquiries with your supplier about whether you were going to retain £750 of my refund for a re-stocking fee. I told you to please come and remove the kitchen. You have said that you ordered the wrong hinges. That is not my fault. I am not responsible for your human errors. I have consumer rights: you have breached them. I dispute that a restocking fee is chargeable because I have been advised that you are in breach of contract. A copy of the invoice you emailed me is available as evidence. I was hoping that we could move forward on this in a gentlemanly and professional manner but I seem to have reached an impasse. It has been almost 24 hours (27th June 2017) since I informed you by telephone that I had bought another kitchen from Howdens and you agreed to collect my kitchen and get back to me suggesting a day and time to do that. Purely because I was brought up with values and manners, I felt obliged to thank you for agreeing to come and collect it. As a result of this nightmare, I have self-certified myself as unfit for work. Your company website talks of your grandfather's and father's well-earned reputation ... "We believe our customer is the heart and soul of every project and endeavour to make your every vision a reality. We are renowned for products of the highest standard and our customers continue to return to enjoy the quality of service and relationships they have built dealing with a true family business." but that is not my experience. This is possibly one of the worst consumer purchases of my life. I was legally advised to send you a letter giving you 14 days to amicably sort this dilemma out and have to be honest and inform you that I am of the opinion that you're now ignoring me. My skilled kitchen fitter is not impressed with your accusation that he is incapable of reading a kitchen plan. I also have a screen print of that remark which I have forwarded to him. He is considering what he does about that. You are not answering your phone, your secretary has messaged you as have I and I have left a text message. You told me yesterday that you're a very busy individual running 3 limited companies and I acknowledge that fact ~ most impressive. No matter how busy our lives, modern technology allows us at the least to send a text to a client "I will contact you within an hour". You're an entrepreneur as I told you - you take risks, enjoy profits and suffer losses. I am not rejecting your kitchen because I have changed my mind. I am rejecting it under breach of contract. I should not be forced to pay for your errors. Would you PLEASE HAVE THE COURTESY AND RESPECT to contact me and advise me when you intend to collect the kitchen that is taking up valuable space in my conservatory. My new kitchen needs to be placed somewhere and I would have thought following that frank telephone conversation yesterday that your company would have the integrity to treat me with courtesy and respect. I have attached screen prints to support these claims on my Facebook page John Richard Challenger. I reserve the right to remove this review at any time I wish.
